Immigration Lawyer

In the USA immigration lawyers deal with all aspects of relationships between the American state and non-US citizens.
Our lawyers deal with all aspects of the immigration law.
Immigration lawyers deal with all types of US visas (both immigration and non-immigration ones), changing visas with or without leaving the USA, family visas and green cards, changing the status, getting work permits, residence permits (green cards), court hearings regarding immigration issues, political asylums, protection against deportation and acquiring American citizenship.
We try to work with those immigration lawyers who speak Russian. Many of them also came to the USA as immigrants. Their personal experience helps us working with our clients during such a difficult for them transition period.
A licenses lawyer will work on your case. No secretaries (the so-called paralegals). Education and experience gained by these lawyers, allows them to determine legal collisions and find solutions of complicated problems. The lawyer personally takes into account and analyses all details and circumstances of your situation. According to the US laws ONLY licensed lawyers can give answers to your questions regarding immigration.
We do know that our clients deserve to be treated with respect, professional and friendly attitude. That is why we respond to calls and e-mail of our current and future clients within 48 hours.
Those people who become our clients (i.е. register a company with our help and sign a contract with us for business management) receive the first consultation by an immigration lawyer free of charge (at the cost of our company).
Because activities of our company are quire specific and many senses are connected with business immigration, we deal with all business issues and all the immigration issues are resolved only by immigration lawyers we cooperate with.
We have to admit that immigration into the US is not an easy procedure, and it has to be followed correctly and in most efficient way. Outcomes of this immigration procedure will influence not only you but also the life of people you care about. That is why people often use professional services of a lawyer.
Do you personally need a lawyer?
At the moment immigration legislation is one of the most complicated and detailed fields of American law. It reflects the fact that the USA is the biggest naturalized “immigration” country in the world, and its development for centuries was connected with inflow of new settlers and the need to ensure state regulation of this process. The issues related to the immigration system are regulated by three federal departments: U.S. Department of State, U.S. Department of Homeland Security and U.S. Department of Labor, as well as dozens of other departments take part in their implementation and resolution.
In spite of the fact that web-pages and respective service centers of these departments provide the basic information, it is not always the best solution to rely on their legal advice. Why? First of all, these centers and web-pages do not have any legal liability or obligation regarding the completeness and correctness of the information they provide. Secondly, federal departments represent the law enforcement system, and provision of professional legal assistance to population is not their direct function. Thirdly, employees of call centers of federal agencies do not have any legal education (!) and often do not improve their qualification according to changing legislation and normative amendments. The forth thing is that circumstances of each case differ greatly from each other, and employees of help centers do not always have an opportunity to learn all the details of your case, which is very important to determining the most optimal and right solution.
Even if you can fill in the immigration forms yourself without any help, the lack of experience can cost you a lot both in terms of time and money.
Later if you do hire a lawyer the options of your case development will be limited and the lawyer will most likely cost you more because he/she will spend more time and efforts on eliminating your initial mistakes.
A good immigration lawyer can provide you with an honest and detailed opinion on your case. He/she will tell you and explain to you all the options available under not only current legislation but also in the view of bills being considered at that time. The lawyer will even prepare your case and will represent your interests in the respective federal agency. The lawyer will also be able to defend your interests in the appeal proceedings.
“Immigration offices” and risks associated with their activities
In most states (New York, New Jersey, Florida, California and Pennsylvania among them) people working as “immigration consultants” violate the law by practicing without the necessary license. Because such people and their offices function beyond the legal field, people who apply for services to «immigration consultants» cannot count on professional and expert presentation of their cases.
US government does not recognize “immigration consultants” and does not allow them to represent your interests in case of any problems with your case.
A lot of “immigration consultants” insist that they are just helping people to fill in forms and petitions. However even government warns people that filing a visa application or filing an application for citizenship is a much more complex procedure than just filling in forms and questionnaires. Questions in immigration forms can seam simple, however they are compiled for getting information connected with complicated aspects of law, and very often a wrong answer results in refusal of the petition and/or deportation of the petitioner from the USA.
That’s why it is better not to take the risk. Work only directly with immigration lawyers.
How to choose the right lawyer?
Choosing the right lawyer is a complicated and important task. Below we describe the factors that can be useful for making the right choice.
AILA (American Immigration Lawyers’ Association) membership- Is the lawyer a member of AILA? AILA is the best source of the most up to date information and data for an immigration lawyer. Although AILA membership is not a 100% guarantee of the quality and merits of a lawyer, the absence of it should make you think about how competent and well informed is this immigration lawyer.
Cost of services – What means of payment is practiced by this lawyer? How does he/she evaluate his/her services? Most immigration lawyers do the work for a fixed payment, although in some cases hourly rates apply (i.е. the amount of payment depends on the time spent by the lawyer). If the cost of the lawyer’s services is beyond the market rates – too low or too high – it should alert you. If there are some unexpected difficulties in your case (some old problems appear, or your case is sent to audit), lawyers would charge an additional fee for this additional work. This fee depends on the scope of such additional work.
Lawyer’s License – you can often meet people who claim they are lawyers but do not have the respective license. That is why before using any services of a lawyer you should verify his/her identity and the lawyer’s license.
Practice focus – Immigration law is a wide area including a number of fields – work visas, family immigration, political asylum, deportation etc. Consider feasibility of turning to a lawyer who specializes in the issues you are interested in.
Practice – How many years does the lawyer practice immigration law? Does he/she have sufficient experience in it? What university did he/she graduate from? Young lawyers who just graduated from schools of law often do not have sufficient experience in resolving complex legal aspects that require time and practice. At the same time elderly lawyers might have problems with actualization of knowledge due to changing legislation.
Availability for contacting – The main complaints regarding lawyers in the USA are caused not by low quality of the provided services, but by inability to contact them when it is necessary. People pay a lot of money for legal services and they should have the right to be confident that the lawyer will answer their calls, letters or e-mail requests in timely manner. In their turn lawyers should inform their clients about development of their cases also in timely manner.
Promising too much – Sometimes you meet lawyers who swear they never lost a case. Be cautious with lawyers who guarantee a 100% positive outcome of your case. A lawyer who informs you about drawbacks or weaknesses of your case deserves more trust. Also avoid lawyers who mention their special influence or personal contacts in federal courts and agencies. Be cautious with lawyers who say negative things about their competitors. A decent lawyer would rather stress his/her achievements than try to damage reputation of his/her competitors.
Our company will recommend you several licensed lawyers. But it’s up to you to decide who you will work with.
